A Mississauga dealer who failed to disclose accident damage repairs greater than $3,000 has been fined $7,000 for breaching Ontario’s Motor Vehicle Dealers Act, said the Ontario Motor Vehicle Industry Council.
The dealer — Emmanuel Ntiri of Edlavi Motors, a used car dealership — acknowledged he sold four vehicles in 2013 without providing written disclosure to the purchasers that the vehicles had been in collisions, according to an agreed statement of facts presented to the OMVIC Discipline Committee.
“The MVDA makes written disclosures mandatory in order to provide transparency to consumers and to create a level playing field for dealers,” said Terry O’Keefe, Director of Communications of the OMVIC, which regulates and inspects Ontario’s 8,000 dealerships and 25,000 salespeople.
For failing to comply with the OMVIC’s Code of Ethics, Ntiri will have to pay the fine within 90 days of the decision and complete the OMVIC Certification Course.
